The Charter of the Jenny De la Torre Foundation (short version)

The Foundation`s Aims

Preamble

Homelessness has become a social problem in Berlin. According to official reports, approximately 10,000 people living in Berlin are without a fixed abode. The estimated number of unreported cases is much higher. Impoverished people suffer dramatic deterioration in their health when forced to live on the streets for extended periods of time. The necessity for open-door, unbureaucratic healthcare sensitive to the needs of homeless people is undisputed. The Jenny De la Torre Foundation should work to meet this need with comprehensive medical, social and psychological care, with the eventual reintegration of homeless patients into society as a final aim.

§ 1 Name, Legal Form, Financial Year

(1) The foundation takes the name

The "Jenny De la Torre Stiftung"

(2) It is a foundation with legal capacity under the Civil Law.
(3) It has its headquarters in Berlin
(4) The foundation`s financial year coincides with the calendar year.

§ 2 The Object of the Foundation

(1) The Foundation`s objective is to sponsor both public healthcare and charitable ventures in compliance with tax law § 53, in particular the support of those in Berlin who are in need and without respect to person, especially those people without a fixed home with reintegration as its aim.

(2) The Foundation`s objective is to be realised through the sponsoring of continued unbureaucratic medical, social and psychological care for poor and homeless people as outpatients.

(3) For the time being, the Foundation will sponsor existing projects providing such care.  As soon as there are sufficient funds available, the Foundation will also seek to fulfil its objective by establishing and maintaining a hostel for the homeless where it can provide such care itself.

§ 3 Tax Exemption

(1) The Foundation pursues objectives that are exclusively and immediately charitable and to the benefit of the public in compliance with the section of the Tax Law defining objectives entitled to tax exemption.
(2) The Foundation does not profit from any of its activities. Primarily, its aims do not include personal financial gain. The Foundation`s funds may be used only for the objectives set out in the charter.
(3) No person may benefit through the use of funds for purposes that are foreign to those of the Foundation or through disproportionate reimbursement.
(4) The Foundation will fulfil its tasks by itself or with auxiliary help in compliance with § 57 section 1 p.2 AO,  provided that, in the course of fundraising, its activities do not come under  § 58 Nr. 1. The Foundation may engage in business designed to further the realisation of its objectives.
